Default State digital signature laws

46 states have adopted laws which recognize the validity of digital signatures. All or portions of state statutes have been pre-empted by E-Sign. Colorado has two digital signature laws: one for the private sector and another for government. Because of federal preemption concerns, states with existing digital signature laws may enact UETA.

How would the combined adoption of UETA and E-Sign and state digital signature laws affect business in Colorado?

These laws, when enacted, will put electronic signatures and documents on the same level as written signature and documents in both the private and public sectors.

that would be great to prevent people from simply forging digital signatures as it's now considered the same as forging real signatures,

but only 46 states, that's too little

Various forms of legislation dealing with internet law have attempted to define and describe digital and electronic signatures for purposes of determining enforceability.The Uniform Electronic Transactions Act (UETA) defines electronic signature as “an electronic sound, symbol, or process attached to or associated with, an electronic record and executed or adopted by a person with the intent to sign the record.”digital signatures are more often than not used as a means of demonstrating affirmative intent. The problems with digital signatures do not stem from inadvertent agreement to terms, but rather from the security and confidentiality of the digital signatures.
